These Terms of Use (“Terms”) govern your use of the Breathwise application (“the App”), developed and operated by Maximilian Schmidt (“we,” “us,” or “our”). By downloading, installing, or using the App, you agree to these Terms.
By accessing or using Breathwise, you confirm that you are at least 13 years of age and agree to be bound by these Terms. If you do not agree, please do not use the App.
Breathwise is a breathing exercise and wellness app. The App is provided for general wellness purposes only and is not intended to diagnose, treat, cure, or prevent any medical condition. Always consult a qualified healthcare provider before beginning any new wellness routine.
Breathwise offers a free tier with limited features and a premium subscription (“Breathwise Premium”) that unlocks additional content and functionality.
Subscriptions are billed through your Apple ID account via the App Store. Payment is charged at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time through your device\'s Settings > Apple ID > Subscriptions.
Free trial eligibility is determined by Apple. If a free trial is offered and you do not cancel before it ends, your subscription will automatically convert to a paid plan.
You may delete your account and all associated data at any time through the App\'s Settings screen. This action is permanent and cannot be undone. Deleting your account does not automatically cancel an active subscription; you must cancel your subscription separately through the App Store.
All content, design, graphics, and other materials in the App are owned by Maximilian Schmidt and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from the App without our prior written consent.
You agree not to reverse-engineer, decompile, or disassemble the App; use the App for any unlawful purpose; attempt to interfere with or disrupt the App\'s functionality; or misrepresent your identity or affiliation when using the App.
The App is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.
To the maximum extent permitted by applicable law, Maximilian Schmidt shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.
We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a new effective date. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.
